These Terms and Conditions (“Terms”) apply to the use of 3dpolyx.com and to purchases made through the website.
The website and online store are operated by SILVERPEAK INNOVATIONS LTD, a company registered in England and Wales under company number 17031194, with its registered office at Dept 7102, 43 Owston Road, Carcroft, Doncaster, United Kingdom, DN6 8DA (“SILVERPEAK”, “we”, “us” or “our”).
3dpolyx.com is an online store for digital 3D models. SILVERPEAK is the seller of the products available on the website.
By using the Store or purchasing a product, you agree to these Terms. If you do not agree with them, you should not use the Store or make a purchase.
1. Accounts and eligibility
You must be at least 18 years old, or otherwise legally capable of entering into a contract in your country, to make a purchase through the Store.
If you are using the Store on behalf of a business or other organisation, you confirm that you have authority to act on its behalf.
Some parts of the Store may require an account. Information provided when registering must be accurate and kept up to date.
You are responsible for keeping your login details secure and for activity carried out through your account. Please contact us at support@3dpolyx.com if you believe that your account has been accessed without permission.
We may suspend or close an account where we have reasonable grounds to believe that it is being used fraudulently, unlawfully or in breach of these Terms.
2. About the Store and our 3D models
3dpolyx.com sells digital 3D models directly to customers.
Customers can browse the available models, view product information and previews, purchase a model and download the relevant files after payment.
All products offered through the Store are sold by SILVERPEAK INNOVATIONS LTD.
The Store does not allow customers or third parties to list or sell their own models. There are no third-party seller accounts, creator payouts or revenue-sharing arrangements.
2.1 Origin of the models
The 3D models sold through 3dpolyx.com are developed by SILVERPEAK's internal team or created specifically for SILVERPEAK by developers, designers, employees or contractors.
Where work is carried out for SILVERPEAK by another person, the relevant arrangements provide SILVERPEAK with the intellectual property rights required to use, reproduce, distribute and sell that work.
SILVERPEAK therefore owns, or otherwise holds the necessary rights to commercially use and sell, the models offered through the Store.
Third parties cannot independently upload or offer their own models for sale on 3dpolyx.com.
2.2 AI-generated content
The 3D models sold on 3dpolyx.com are not AI-generated.
We do not provide an AI model-generation service. Models are produced through conventional 3D modelling and design processes by or for SILVERPEAK.
2.3 Digital delivery
All products are supplied digitally.
Once an order has been accepted and payment completed, the purchased files are made available electronically. Depending on the Store functionality, this may be through a customer account, download page, download link or another method shown during the purchase process.
No physical goods are supplied.
3. Intellectual property
3.1 Ownership
The 3D models and related files sold through 3dpolyx.com, together with their textures, materials, previews, renders, product images and other associated materials, are owned by SILVERPEAK or used by SILVERPEAK under rights that permit their commercial distribution.
Copyright and other intellectual property rights in a model do not pass to the customer when the model is purchased.
A purchase gives the customer the right to use the model as set out below. It does not amount to a sale or assignment of the copyright or other intellectual property rights in the model.
The website itself, including its branding, design, graphics, text and other original content, is also owned by or licensed to SILVERPEAK.
3.2 Use of purchased models
After successful payment, the customer may use the purchased model for personal or commercial projects.
This right is non-exclusive, worldwide, non-transferable and non-sublicensable.
There is no separate licence certificate or licence document issued with the purchase. The customer's right to use the model arises automatically once the purchase has been completed and is subject to these Terms and any specific conditions shown on the relevant product page before purchase.
A purchased model may be used as part of a finished project, including a visualisation, animation, game, application, digital environment, advertisement, presentation, film or other audiovisual or digital production.
Commercial use of such finished projects is permitted.
The important distinction is that the customer may commercially use a project incorporating the model, but may not commercially redistribute the underlying 3D model itself.
3.3 What you may not do
Unless we have agreed otherwise in writing, you may not:
- resell the model or its source files;
- share or distribute the model files to third parties;
- upload the model to another 3D asset store, library, repository or file-sharing service;
- make the model available as a standalone downloadable asset;
- sublicense the model or grant another person independent rights to it;
- claim to be the author or owner of the underlying model; or
- use the model in a way that infringes applicable law or third-party rights.
You may modify a purchased model for use in your own project. This includes reasonable changes to its geometry, size, textures, materials or technical format.
Modifying a model does not give you ownership of the original intellectual property. A modified or converted version may not be resold or distributed as a standalone 3D asset.
3.4 Intellectual property complaints
If you believe that material available on 3dpolyx.com infringes intellectual property rights, please contact support@3dpolyx.com.
Your notice should identify the relevant material, the right you believe has been infringed, the basis of your claim and your contact details.
We will review properly submitted complaints and may temporarily remove or restrict access to the relevant material while a claim is being investigated.
4. Orders
When you place an order, you offer to purchase the selected product at the price shown at checkout.
An order is accepted once payment has been successfully authorised and the order has been confirmed by us.
We may refuse or cancel an order where there is an obvious pricing or technical error, a payment problem, suspected fraud, a legal or regulatory restriction, or another legitimate reason preventing us from completing the transaction.
If we cancel an order after taking payment, the amount paid for the cancelled order will be returned where applicable.
5. Prices and payment
The price payable for a product is the price shown at checkout when the order is placed.
Prices may change from time to time, but a later price change will not affect a completed purchase.
Any applicable taxes will be included or calculated during checkout as required. The total payable amount will be shown before the customer confirms the purchase.
Payments are handled by third-party payment service providers. Payment transactions may be subject to authentication, fraud checks and approval by the relevant bank, card issuer or payment provider.
Where payment card information is entered directly into a payment provider's systems, SILVERPEAK does not store the customer's full card details.
A payment may be declined because of insufficient funds, incorrect payment details, an expired or unsupported payment method, failed authentication, security checks or restrictions imposed by the customer's bank or payment provider.
6. Digital content and refunds
6.1 Immediate access
The products sold on 3dpolyx.com are digital content and may be supplied immediately after payment.
Where consumer law requires it, the customer may be asked at checkout to consent to immediate supply and to acknowledge the effect this has on any statutory cancellation period.
Nothing in these Terms removes consumer rights that cannot legally be excluded.
6.2 Refunds
Due to the nature of downloadable digital content, we generally do not provide refunds after a model has been downloaded, accessed or otherwise supplied.
This does not apply where a refund or other remedy is required by law.
Please contact support@3dpolyx.com if:
- you cannot access the purchased file because of a problem with the Store;
- the file is corrupted or materially defective;
- the product is materially different from its description;
- you have been charged more than once for the same order; or
- you believe a transaction was unauthorised.
Where a technical problem can reasonably be corrected, we may first provide a replacement or corrected file.
Approved refunds are normally returned to the original payment method.
6.3 Payment disputes
If there is a problem with a purchase, please contact us before starting a payment dispute so that we have an opportunity to investigate it.
If a chargeback or other payment dispute is opened, we may provide the relevant payment provider, bank or card scheme with information relating to the transaction. This can include the order details, product information, proof of digital delivery or download and relevant customer communications.
This does not affect any rights available to you under applicable consumer law or card scheme rules.
7. Use of the Store
You must not misuse the Store or interfere with its normal operation.
In particular, you must not attempt to gain unauthorised access to accounts or systems, introduce malicious software, circumvent payment or download controls, systematically scrape Store content without permission, or use the Store for fraudulent or unlawful purposes.
We may restrict access to the Store or an account if we reasonably believe that these Terms have been breached or that the Store is being used unlawfully.
8. Sanctions and legal restrictions
We will not provide products or services where doing so would breach applicable sanctions, export controls or other legal restrictions.
We may refuse, delay or cancel a transaction where this is required to comply with applicable law or with legitimate compliance requirements imposed by our payment providers, banking partners or card schemes.
9. Privacy
SILVERPEAK processes personal data in accordance with applicable data protection law, including the UK GDPR and the Data Protection Act 2018 where they apply.
We may process personal information to operate the Store, administer accounts, process and fulfil orders, provide downloads, handle payments and customer support, prevent fraud, maintain transaction records and comply with legal obligations.

Payment providers and other service providers may process personal information under their own privacy policies.
10. Product information and compatibility
We make reasonable efforts to ensure that product descriptions, previews and technical information are accurate.
Before purchasing a model, you should review the information on the product page and make sure that the relevant file format and technical characteristics are suitable for your intended software, hardware and project.
Preview images and renders are illustrative. The appearance of a model can vary depending on software, rendering engine, lighting, materials, settings and modifications made by the customer.
11. Availability and warranties
We aim to keep the Store available and functioning correctly but cannot guarantee uninterrupted or error-free access at all times.
Unless stated otherwise on the product page, we do not guarantee that a model will be compatible with software, hardware or workflows that are not identified as supported.
Nothing in these Terms excludes any warranty, guarantee or consumer right that cannot legally be excluded.
12. Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot legally be excluded or limited.
Subject to those exceptions and to applicable consumer law, SILVERPEAK will not be responsible for indirect or consequential losses arising from the use of the Store or a purchased product, including loss of profits, business, revenue, data or goodwill.
To the extent permitted by law, our total liability in connection with a particular purchase will not exceed the greater of the amount paid for the transaction giving rise to the claim or £100.
Nothing in this section affects mandatory consumer rights.
13. Suspension and termination
We may suspend or close an account if it is used fraudulently or unlawfully, if these Terms are materially breached, if our intellectual property is being improperly distributed, or if suspension is required for security, legal or compliance reasons.
Where appropriate, we will give the customer an opportunity to resolve the issue before an account is permanently closed.
Closing an account does not affect SILVERPEAK's ownership of its intellectual property or any rights and obligations which are intended to continue after termination.
14. Changes to these Terms
We may amend these Terms from time to time to reflect changes to the Store, our business, payment arrangements or applicable law.
The date at the top of this page shows when the Terms were last updated.
Where required by law, we will give appropriate notice of material changes affecting existing customers.
Changes to these Terms do not retrospectively remove statutory rights relating to purchases already made.
15. Governing law
These Terms and any dispute or claim arising from them are governed by the laws of England and Wales.
The courts of England and Wales have non-exclusive jurisdiction in relation to disputes arising from these Terms.
Consumers living outside the United Kingdom may also have mandatory rights under the laws of their country of residence. These Terms do not override consumer protections which cannot legally be excluded.
16. General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
A failure by SILVERPEAK to enforce a provision of these Terms does not waive our right to enforce it later.
You may not transfer your rights or obligations under these Terms without our written consent.
We may transfer our rights or obligations as part of a sale, restructuring or transfer of our business, subject to applicable law.
These Terms should be read together with our Privacy Policy, Refund Policy, Cookie Policy and any product-specific terms shown before purchase.
